Prince George's County Classic $1,000 Scholarship Contest
OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
- Eligibility: The Prince George's County Classic $1,000 Scholarship Contest (the “Promotion”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of State Farm Mutual Automobile Insurance Company, Tukaiz, LLC, Tribal DDB Worldwide, ePrize, LLC, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes participant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Promotion.
- Sponsor: State Farm Mutual Automobile Insurance Company, One State Farm Plaza, Bloomington, IL 61710. Administrator: ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069.
- Timing: The Promotion begins on September 19, 2008 at 12:00 a.m. Eastern Time ("ET") and ends on October 18, 2008 at 11:59 p.m. ET (the "Promotion Period"). Sponsor's computer is the official time-keeping device for the Promotion.
- How to Join a Team: During the Promotion Period, visit http://www.50millionpounds.com and follow the links and instructions to create or login to your 50millionpounds.com account (the "Account"). Creating an Account is free. Once logged into your Account, follow the links and instructions to join a team, either the “Bowie State University Alumni Bulldogs” or the “Lincoln State University Alumni Lions.”. Limit: You may join one (1) team during the Promotion Period. Multiple participants are not permitted to share the same email address. Any attempt by any participant to join more than one (1) time by using multiple/different email addresses, identities, registrations and logins, or any other methods will void all of the times that participant joined a team and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
- Selection of Award Recipient: The team that the most participants join during the Promotion Period will be the potential award recipient. In the event of a tie, Administrator will randomly select the potential award recipient in a random drawing between the two (2) teams. The potential award recipient will be notified on or around November 10, 2008 by mail, email or phone. The potential recipient may be required to sign and return to Sponsor, within ten (10) days of the date notice or attempted notice is sent, any documentation or paperwork required by Sponsor or Administrator in order to claim its award. If a potential award recipient cannot be contacted, or fails to sign and return required paperwork (if any) within the required time period, it forfeits the award. In the event that the potential recipient is disqualified for any reason, Sponsor will award the award to the other team.
- Award: A $1,000 scholarship check issued to the Alumni Association of the university associated with the winning team (either Bowie State University Alumni Association or Lincoln State University Alumni Association, depending on which receives the most votes, per Section 5 above). Approximate Retail Value (“ARV”): $1,000. Award is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. The recipient is responsible for all taxes and fees associated with award receipt and/or use.
- Release: By receipt of an award, recipient agrees to release and hold harmless Sponsor, Tukaiz, LLC, Tribal DDB Worldwide, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and award suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any award.
- Publicity: Except where prohibited, participation in the Promotion constitutes participant or recipient’s consent to Sponsor’s and its agents’ use of participant or recipient’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
- General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Any trademarks used in this promotion are the property of the respective trademark owners and are used for identification purposes only.
- Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Promotion or receipt or use or misuse of the award. If for any reason a participant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, participant’s sole remedy is another entry in the Promotion. No more than the stated number of awards will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of awards as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of awards by a random drawing among all legitimate, un-awarded, eligible award claims.
- Disputes: Except where prohibited, participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any award awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
- Participant's Personal Information: Information collected from participants is subject to ePrize, LLC’s Privacy Policy http://www.eprize.com/privacy/privacypolicy.html and Sponsor’s Privacy Policy http://www.statefarm.com/about/privacy.asp.
- Recipient List: Recipient List requests will only be accepted after the promotion end date (listed above) and no later than March 10, 2009.
