The 50 Million Pound Challenge Fountain City Classic Challenge Contest

OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. THIS CONTEST IS FOR THE INTENDED PARTICIPATION OF AND THE PROMOTION OF THE 2008 FOUNTAIN CITY CLASSIC CHALLENGE.

  1. Eligibility: The 50 Million Pound Challenge Fountain City Classic Challenge Contest (the “Contest”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of State Farm Mutual Automobile Insurance Company, Tukaiz, LLC, Tribal DDB Worldwide, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. This contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes participant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Contest.

  2. Sponsor: Dr. Ian Smith, P.O. Box 651 Franklin Park, IL 60131; Prize Provider: State Farm Insurance, 1 State Farm Plaza, Bloomington, IL 61710; State Farm is in the business of insurance and financial products and services.

  3. Contest Start and End Dates: The Contest begins on October 3, 2008 at 12:01 a.m. Central Time ("CT") and ends on November 15, 2008 at 11:59 p.m. CT (the "Contest Period"). Sponsor's computer is the official time-keeping device for the Contest. The Alumni Associations will be notified of the declared potential winner.

  4. How to Enter: During the Contest Period, visit www.50millionpounds.com and follow the links and instructions to create or login to your 50millionpounds.com account (the "Account"). Creating an Account is free. Once logged into your Account, follow the links and instructions to join a team, either the “FVSU Alumni Wildcats” or the “ASU Alumni Rams”. Limit: You may join one (1) team during the Contest Period. Multiple participants are not permitted to share the same email address. Any attempt by any participant to join more than one (1) time by using multiple/different email addresses, identities, registrations and logins, or any other methods will void all of the times that participant joined a team and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

  5. Selection of Award Recipient: To be declared the official winner, the winning team will need to have a minimum of 100 people join the team to qualify for the 1st Place prize of $1,000. The team that has the most participants join (above the 100 person minimum) during the Contest Period will be the potential 1st place award recipient. In the event of a tie, Administrator will randomly select the potential award recipient in a random drawing between the two (2) teams.

  6. The Alumni Associations will be notified of the potential award recipient on or around November 10, 2008, by mail, email or phone. The potential recipient may be required to sign and return to Sponsor, within ten (10) days of the date notice is sent, any documentation or paperwork required by Sponsor or Administrator in order to claim its award. If a potential award recipient cannot be contacted, or fails to sign and return required paperwork (if any) within the required time period, it forfeits the award. In the event that the potential recipient is disqualified for any reason, Sponsor will award the award to the other team, providing the 100 person threshold has been met. If neither team exceeds the threshold minimum, no award will be given.

  7. Award: First Place - $1,000 prize check issued to the alumni association of the university associated with the winning team (either Fort Valley State University or Albany State University, depending on which receives the most members, per Section 5 above).

  8. Awards are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. The recipient is responsible for all taxes and fees associated with award receipt and/or use.

  9. Odds: Odds of winning depend on the number of qualified entries received. Purchase of any products or services from Dr. Ian Smith or State Farm will not improve odds of winning.

  10. Release: By receipt of an award, recipient agrees to release and hold harmless Sponsor, Tukaiz, LLC, Tribal DDB Worldwide, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and award suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any award.

  11. Publicity: Except where prohibited, participation in the Contest constitutes participant or recipient’s consent to Sponsor’s and its agents’ use of participant or recipient’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

  12. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Any trademarks used in this contest are the property of the respective trademark owners and are used for identification purposes only.

  13. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Contest or receipt or use or misuse of the award. If for any reason a participant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, participant’s sole remedy is another entry in the Contest. No more than the stated number of awards will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of awards as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of awards by a random drawing among all legitimate, un-awarded, eligible award claims.

  14. Disputes: Except where prohibited, participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any award awarded shall be resolved individually, without resort to any form of class action, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Illinois without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.
